Terms of Service

These Terms of Service ("Terms") govern your use of the SMB AI Guy website and AI Readiness services (collectively, the "Service") provided by Enthropic Data LLC ("we," "us," or "our"), located in Weddington, NC. By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

SMB AI Guy provides AI visibility audits and ongoing monitoring services for local businesses. The Service analyzes how well your business is represented in AI assistant responses (such as ChatGPT, Perplexity, and Google Gemini) and delivers reports and recommendations to improve that visibility.

We offer a free one-time audit and paid subscription plans as described on our pricing page. Feature availability and pricing may change; existing paid subscribers will be notified at least 30 days in advance of material changes affecting their plan.

2. Eligibility

You must be at least 18 years old and authorized to enter contracts on behalf of any business you represent. By using the Service, you confirm you meet these requirements.

3. Account & Access

Access to paid features requires a verified email address. You are responsible for keeping your login credentials secure. We use passwordless magic-link authentication — notify us immediately at dbrown@smbaiguy.com if you suspect unauthorized access to your account.

4. Subscriptions & Payments

Paid subscriptions are billed monthly or annually as selected at checkout. All payments are processed by Stripe. By providing payment information, you authorize us to charge the applicable fees on a recurring basis until you cancel.

Subscriptions auto-renew at the end of each billing period. You may cancel at any time from your account portal; cancellation takes effect at the end of the current paid period and no prorated refunds are issued for unused time. If a payment fails, we will retry up to three times over five days before suspending access.

5. Free Audit

The free AI Readiness audit is available once per business location. We reserve the right to limit or discontinue the free audit at any time. The free audit report is for informational purposes only and does not constitute a guarantee of AI visibility outcomes.

6. Your Responsibilities

You agree not to:

  • Submit false or misleading business information
  • Use the Service to audit businesses you do not own or have explicit authorization to represent
  • Attempt to reverse engineer, scrape, or automate requests to our Service
  • Use the Service in any manner that violates applicable law

7. Intellectual Property

All content, reports, scoring methodologies, software, and branding on the Service are owned by Enthropic Data LLC or its licensors. Your audit reports are licensed to you for your own business use only and may not be redistributed or resold.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind. We do not guarantee that your AI visibility scores will improve, that AI assistants will recommend your business, or that the Service will be uninterrupted or error-free. AI assistant outputs are outside our control and may change at any time.

9. Limitation of Liability

To the fullest extent permitted by law, Enthropic Data LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or for any other reason with reasonable notice. You may stop using the Service at any time. On termination, your data will be retained for 90 days before deletion, during which you may request an export.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Union County, NC.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to active subscribers. Continued use of the Service after the effective date of any revision constitutes acceptance of the updated Terms.
